A recent Johannesburg High Court judgment has drawn significant attention in the sectional title and estate industry, particularly regarding how bodies corporate recover unpaid levies from owners. The case involved levy arrears of approximately R18,000, but the related legal costs reportedly escalated to almost five times the original debt.

The court refused to grant immediate judgment and instead allowed the homeowner to defend the matter, highlighting growing judicial concern around excessive and disproportionate legal costs in levy collection matters. Importantly, the court emphasised that levy recovery processes must remain fair, transparent, and proportionate to the debt being claimed.

The judgment also confirmed that acknowledgements of debt (“AODs”) are not automatically enforceable if they contain questionable or excessive charges. Trustees and managing agents are expected to maintain proper oversight of levy recovery processes and cannot simply leave all decisions to attorneys without accountability.

This case serves as an important reminder that while levy collection remains essential to the financial health of community schemes, recovery strategies must be carefully managed and legally justifiable. The ruling is likely to influence how future levy disputes are approached in South Africa’s sectional title environment.
