Antenuptial Contract
An ANC provides clarity, security, and peace of mind by defining your financial relationship. It safeguards your individual assets, ensures fair distribution of accumulated wealth, and prevents potential conflicts.
An Antenuptial Contract (ANC) is a legally binding agreement signed before marriage, designed to protect your financial interests and outline the distribution of assets and liabilities in the event of divorce or death. Without an ANC, couples are automatically married in community of property, meaning all assets and debts are shared equally
Types of Marital Property Regimes in South Africa
- Marriage in Community of Property: All assets and liabilities are shared equally.
- Marriage Out of Community of Property: Requires an ANC and can be with or without accrual.
- Marriage Out of Community of Property Without Accrual: Each partner retains their own assets and liabilities.
- Marriage Out of Community of Property With Accrual: Each partner retains their own assets and liabilities, but any wealth accumulated during the marriage is shared.
